PCS (J) Notes: Distinction between complaint & FIR

Complaint (Sec 2 (d) ) FIR (Sec 154)
Complaint is made orally or in writing to a magistrate. FIR is given to officer in charge of a police station.
Complaint may relate to cognizable/non-cognizable offence. FIR must relate to a cognizable offence or case.
Magistrate may take cognizable of an offence on complaint made to him. Magistrate can not take cognizance on first information report.
Complaint does not include police report. FIR may be given by police officer.
