SC pronounced its judgment on Rafale Case Review

The Supreme Court today dismissed the preliminary objection in its judgment on the Rafale Case Review petition wherein the Centre had raised preliminary objections to the admissibility of certain documents.

The Judgment was pronounced today on 10:30 AM. Justice K M Joseph wrote a separate judgment concurring with CJI Gogoi and Justice S K Kaul.

A bench of CJI Gogoi and Justice S K Kaul and Joseph had on 14 March reserved its decision after hearing the centre and petitioners – former Union Ministers Yashwant Sinha, Arun Shourie and advocate Prashant Bhushan – on the question of admissibility of documents. The centre had objected to the admissibility of certain papers that were published by The Hindu newspaper and later carried by news agency ANI.

The Court was hearing the review petitions filed by Prashant Bhushan, Yashwant Sinha and Arun Shourie against the December 14 judgment. Listed along with the review petition were the correction petition filed by the Central Government and the petition filed for initiating perjury proceedings against officials who allegedly misled the Court by submitting false information in the notes submitted to the Court.

The Court said that the review petitions will be heard on merits and a date will be fixed for that.
