Adv Sunil Kumar Stood Firmly for Closure of Brothels Even After Life Threats

The division bench of Allahabad High Court headed by Chief Justice of Allahabad High Court Govind Mathur and Saurabh Shyam Shamshery in Sunil Choudhary V. State of U.P. PIL No. 4895 of 2018 entertained the matter and mentioned that the Public Interest Litigation is before us with an allegation that in the city of Meerut several brothels are in operation and the District Administration is not taking any steps as required under Prevention of Immoral Trafficking Act as well as under other relevant provisions. According to the petitioner 75 brothels have been noticed by the Governmental agencies and contraceptives too were distributed at such places by the governmental agencies. It is also brought to our notice that the brothels have become centre of criminal activities and even a murder has taken at one such place. It is asserted by the petitioner that the brothel existing in the city of Meerut at the one hand depicts acute exploitation of females including minors and on the other hand is causing huge injury to the young generations as well as peaceful fabric of family system.

The court looking into the gravity of the matter directed to the administration, “Having considered the facts of the public interest litigation, we deem it appropriate to direct the Additional Chief Secretary to the Government of Uttar Pradesh, Department of Home Affairs to issue necessary instructions to the District Magistrate, Meerut as well as to the Senior Superintendent of Police, Meerut to take immediate steps to stop operation of the brothels, if any, in the city of Meerut and further to proceed in accordance with the provisions of the Prevention of Immoral Trafficking Act, and other relevant provisions. The Additional Chief Secretary to the Government of Uttar Pradesh, Department of Home Affairs shall obtain a complete report with regard to the steps taken and also about the objections which relates to the allegations made in the public interest litigation from the District Magistrate, Meerut and shall place the same on record of this public interest litigation before the next date of listing.”

The Court also observed, It is also brought to our notice notice that certain threats have been advanced to the petitioner who is a practicing Advocate of this Court for pressurizing him to withdraw this public interest litigation. It is made clear that being a public interest litigation and cognizance of which has already been taken by this Court, the same cannot be withdrawn even if the petitioner desires” and directed to the District Magistrate, Allahabad to ensure necessary security to the petitioner.
