Amidst the ongoing Maharashtra political crisis, the Supreme Court bench of Justice Ramana, Justice Ashok Bhushan and Justice Sanjiv Khanna today ordered that floor test for proving the majority of Devendra Fadnavis government before 5 PM tomorrow. The bench also ordered that the test should be held through open ballet, videogrpahed and telecasted live. The orders were passed on the petition filed by Shiv Sena, Nationalist Congress Party, and Congress against the decision of Maharashtra Governor to invite Devendra Fadnavis to form government in Maharashtra. Background BJP-NCP coalition formed the government. In the 228-member Assembly BJP have 105 seats while NCP has 54. The BJP needed the support of at least 10 MLAs to stake a claim. BJP-NCP alliance came as a shock as yesterday the alliance between Shiv Sena, NCP and Congress reached a consensus that Uddhav Thackeray would be the new Chief Minister of the state, heading a government of their alliance. Taking note of the sudden political developments in Maharashtra, NCP chief Sharad Pawar said his nephew Ajit Pawar’s decision to ally with the BJP was a “personal” one and not taken by the party. In a dramatic turn of events on Saturday morning Devendra Fadnavis took oath as the Maharashtra Chief Minister along with NCP leader Ajit Pawar as his deputy. Maharashtra Governor Bhagat Singh Koshyari administered the oath to the two leaders at Raj Bhawan. On the decision of revoking President rule and calling BJP to form the government was questioned by Shiv Sena NCP and Congress alliance. They moved to Supreme Court and raised the same question. The petitioners asked the Supreme Court to declare the Governor's decision to invite Devendra Fadnavis to form the Government as "unconstitutional, arbitrary, illegal, void-ab-initio, and violative of Article 14 of Constitution of India". The Supreme court in special sitting had called for the correspondences between Fadnavis and Maharashtra Governor Bhagat Singh Koshyari to be produced on Monday at 10.30 AM. After Mondays hearing the Supreme Court had reserved its order to be announced today.
